Houses of Multiple Occupation: Consultation Period

Houses of Multiple Occupation (HMO) are part of the mix of housing across cities. In the East Midlands, other cities such as Nottingham & Leicester have enacted Article 4 directions to allow for a good mix. Derby City Council is intending to follow in that path.

It involves landlords needing planning permission to change the use of a building from a family home (single occupancy) to a HMO. This is because residents feel that a large number of HMOs in one area affects the whole community with issues being the transient nature of many tenants, high numbers of extra cars needing parking spaces as well as problems with overfilled bins etc.

HMOs are going to continue to be part of the rental scene with planning permissions being granted in some circumstances.

The information is below with contact details if you have any comments during the consultation period. This runs from 2 April 2024 until Friday 31 May and covers Darley ward.

NOTICE OF ARTICLE 4 DIRECTION MADE UNDER ARTICLE 4(1) OF THE TOWN AND COUNTRY PLANNING ACT (GENERAL PERMITTED DEVELOPMENT) (ENGLAND) ORDER 2015 (AS AMENDED)

 

CONSULTATION:  ARTICLE 4 DIRECTION FOR DERBY CITY

 

Derby City Council made an Article 4(1) Direction on the 10th of January 2024 under Article 4(1) of the Town and Country Planning Act (General Permitted Development) (England) Order 2015 to be confirmed after 12 months has elapsed, in 2025, following assessment of this consultation.

The Direction relates to development consisting of a change of use of a building from a use falling within Class C3 (dwellinghouse) of Part 3 of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) to a use falling within Class C4 (small houses in multiple occupation) of Part 3 of that Schedule and removes permitted development rights for this type of development if confirmed in 2025.

Planning permission will therefore be required for change of use from a dwelling to a House in Multiple Occupation once this Derby City Article 4 Direction is in place.

The Derby City Article 4 Direction applies to a large part of the central area of the City, the whole of Arboretum Ward and those parts of Abbey, Alvaston North, Darley, Mackworth & New Zealand, Normanton and Sinfin & Osmaston that are within the Ring Road.
